“Got Some” Music Industry 2.0?

As of June 16, 2009, if you go to The Tonight Show with Conan O’Brien’s website’s music performance section, there will only be one song:  “Got Some” by Pearl Jam.  Since Pearl Jam currently has no record contract, and therefore they do not have to share publishing rights for their latest material with anyone else, Pearl Jam themselves probably gave NBC the OK to post “Got Some” online for a very long time (Pearl Jam was Conan’s first musical guest).

This is presumably an example of good strategy in the world of Music Industry 2.0 (and higher):  If you’re not signed with Music Industry 1.0 record companies, be loose (but not stupid) with your Internet intellectual property rights so that you can market your material.  If you’re part of the Music Industry 1.0 dinosaurs, well, you gotta figure out some stuff fast…otherwise, evolution will leave you behind.

While Pearl Jam’s “Got Some” is still online, their cover performance of Neil Young’s “Rockin’ in the Free World” (publishing rights presumably split between Young and his record company at the time, and possibly other publisher administrators) was on and off NBC’s servers pretty quickly.  The same can be said of the latest material from Music Industry 1.0 recording artists Green Day (Reprise), Sheryl Crow (A&M), John Mayer Trio (Columbia), etc. – the lawyers of NBC Universal are still dealing with the lawyers of its conglomerate peers in order to figure out if they should have streaming video performances of this intellectual property.
